Privacy Policy

1. Who we are

Overguard Technologies Ltd (“Overguard”, “we”, “us”) operates the Overguard connected workforce safety platform, accessible at overguard.app. We are registered in England and Wales. Our data protection contact is privacy@overguard.app.

2. What data we collect

We collect the following categories of personal data through our platform:

  • Worker identity data: name, employer, trade, qualifications, and emergency contacts — provided by the employing organisation
  • Location data: GPS and BLE positioning updated approximately every 5 seconds during active shifts
  • Safety event data: fall detection, impact events, SOS activations, and alert triggers
  • Environmental data: gas readings, noise exposure, temperature — collected from device sensors
  • Biometric data (optional, consent required): heart rate and fatigue indicators — only collected with explicit individual consent
  • Device data: battery level, connectivity status, firmware version
  • Account data: name, email address, role — for platform administrators and supervisors

3. How we use your data

Worker safety monitoring: real-time location and sensor data is used solely to protect worker safety and enable emergency response.

Platform operation: account data is used to operate and secure your organisation's platform access.

Safety analytics: aggregated and anonymised data is used to generate safety reports and risk analysis for your organisation.

We do not use worker location data for performance monitoring, productivity tracking, or any purpose other than safety.

4. Legal basis for processing

We process personal data under the following legal bases:

  • Legitimate interests: safety monitoring of workers in hazardous environments
  • Contract performance: providing the platform services to the employing organisation
  • Legal obligation: compliance with health and safety legislation
  • Consent: biometric data processing (explicit individual consent required)

5. Data retention

Active shift data: retained for 90 days from collection. Incident records: retained for 7 years in accordance with health and safety legislation. Account data: retained for the duration of the contract plus 30 days. Biometric data: retained for 30 days unless extended consent is given.

6. Your rights

Under UK GDPR you have the right to: access your personal data, correct inaccurate data, request deletion of your data, restrict or object to processing, and data portability. Workers can exercise these rights through the Overguard Worker App or by emailing privacy@overguard.app.

7. Data transfers

Data for UK customers is stored in AWS EU-WEST-2 (London). Data for Australian customers is stored in AWS AP-SOUTHEAST-2 (Sydney). We do not transfer personal data outside these regions without explicit contractual agreement.

8. Cookies

We use essential cookies for platform authentication and session management. We do not use advertising or tracking cookies. You can manage cookie preferences through your browser settings.
